The video shows Higgins admitting to police that he had been drinking before the crash and was driving home from a nearby Taco Bell.

“I mean, I’ve been drinking beer, but I’ve never had it within two hours,” Higgins said. “Since the accident happened, about an hour or so.”

The police told Higgins they needed to check on him and asked him if he had been injured in the accident.

“I’m just surprised,” Higgins replied.

While trying to do a sobriety test, Higgins told police, “I’m sorry. I’m just busy. What should I do again?”

“You said it’s been an hour since you had your last drink?” asked one of the Higgins officers.

Higgins admitted to having “five or six” Miller Lites since noon.

After a field sobriety test, Higgins was handcuffed, read his rights and taken to the police station. His blood alcohol level was later revealed to be .087 – over the legal limit of .08.

Higgins faces two counts of vehicular manslaughter, reckless driving, possession of an open container and consumption of alcohol in a motor vehicle.

He faces up to 20 years in prison if convicted.

The County Sheriff’s Office also issued a 911 call the night the Gaudreau brothers were killed.

“I just saw a collision between two people on bicycles,” one caller told the dispatcher. The operator later corrected the statement, saying that the driver was standing on the side of the road.

The dispatcher asked, “Is anyone hurt?”

Higgins last appeared in court on November 12 during a hearing in which members of the Gaudreau family were present.

During the trial, a 30-day extension was granted to federal prosecutors to file charges against Higgins.
