DeSantis boss banned from threatening TV channels for pro-abortion ads

A Florida state judge issued a temporary restraining order on Thursday, stopping the state government from threatening to pursue legal action against television stations over ads promoting abortion.

Floridians Protecting Freedom, a pro-abortion group behind the Amendment 4 Right to Abortion Initiative, which will end the ban on abortion at 6 weeks in Florida by including abortion in the state constitution, filed its lawsuit against Florida Surgeon General Joseph Ladapo and the former General Counsel to the doctor. Florida Department of Health John Wilson earlier this week.

The language of the 4th amendment states, “No law shall prohibit, penalize, delay, or restrict abortion before it takes place or if it is necessary to protect the health of the patient, as determined by the patient’s health care provider.”

The lawsuit was prompted after the Florida Department of Health sent letters to television stations that aired ads promoting abortion, which the department said were “false” and “harmful.” The department continued to request that the ads be removed within 24 hours, or it will pursue legal action.

Floridians Protecting Freedom argued that such a move is a violation of a group’s First Amendment right to run political ads in support of the proposed amendment.

“Although Defendant Ladapo refuses to even acknowledge this simple fact, Plaintiff’s political ad is political speech—speech at the heart of the First Amendment,” District Judge Mark E. Walker wrote in the order.

“The government will not condone the censoring of political speech simply by stating that unapproved speech is ‘false.’ ‘The very purpose of the First Amendment is to restrict public authority from taking care of the public mind by regulating the press, speech, and religion,'” Walker continued, citing the US Supreme Court’s opinion.

“The truth is, these ads are blatantly false and a danger to public health in Florida,” said Jae Williams, director of communications for the Florida Department of Health, in a statement to Fox News Digital. “The media continues to ignore the fact that Florida’s birth control law always protects the health of the mother and includes exceptions for victims of rape, incest, and human trafficking.”

Lauren Brenzel, director of the Yes on 4th campaign, called the order “a victory for every Floridian who believes in democracy and the sanctity of the First Amendment” in a statement released shortly after the order was issued.

“The court confirmed what we’ve known all along: the government cannot silence the truth about Florida’s extreme abortion ban. It’s a deadly ban that puts women’s lives at risk,” the statement continued. “This decision is a powerful reminder that Floridians will not back down in the face of government intimidation.”
