The January 6 charges against Trump were dismissed following a request by Special Counsel Smith

A judge has dismissed the charges against President-elect Donald Trump in the DC case against him, following a request made by Special Counsel Jack Smith on Monday.
The decision affects the investigation of violations of Jan. 6 US Capitol. Fox News Digital learned of Smith’s request earlier Monday.
“The Government has moved to dismiss the Superseding Case without prejudice,” US District Judge Tanya Chutkan wrote in the ruling. “The defendant does not oppose the Motion…and the court will grant it.”
Smith also filed a motion to withdraw his plea in his secret lawsuit against Trump — a case that was dismissed in July by federal Judge Aileen Cannon. Cannon ruled Smith was illegally appointed as special counsel.

The moves come after Smith, earlier this month after Trump won the 2024 presidential election, indicated that he would begin withdrawing his lawsuit against Trump. Filing of the application began live at the Department of Justice docket on Monday afternoon.
Smith had already filed a motion to waive all deadlines in the 2020 election meddling case against Trump in Washington, DC – a move that was widely expected, but stopped short of completely dropping the case against Trump. Smith had said his team planned to provide an updated report on the legal status of the case against Trump on December 2.
Trump denied all charges in the case and went to war US Supreme Court, arguing on the basis of presidential immunity.
The high court ruled that Trump cannot be prosecuted for the president’s official actions, forcing Smith to file a new lawsuit. Trump has not denied the new charges. Trump’s lawyers wanted the election meddling charges dropped in Washington DC, arguing that Smith was illegitimately nominated.

Today’s DOJ decision ends the unconstitutional charges against President Trump, and is a huge victory for the law,” a Trump spokesman and incoming White. In-house communications director Steven Cheung said in a statement. “The American people and President Trump demand an immediate end to the use of political weapons in our justice system and we look forward to uniting our country.”
Trump has denied all charges brought against him by Smith’s investigation.
Smith is expected to resign as special counsel before Trump takes office.
Trump posted on Truth Social on Monday afternoon that the charges against him were “vulnerable and unconstitutional and should never have been brought.”

“These lawsuits, like all the other lawsuits I have been forced to go through, are empty and illegal, they should never be brought. Over $100 Million Dollars of Taxpayer Dollars have been wasted in the Democratic Party’s fight against their political opponent. ME,” said Trump. “Nothing like this has ever happened in our country before.”
Trump said that “federal prosecutors and district attorneys, such as Fani Willis and her lover, Nathan Wade (who had absolutely no experience in cases like this, but were paid MILLIONS, enough to take many trips and cruises around the world!), Letitia James, who campaigned unfairly, unfairly, unfairly, and perhaps illegally, ‘GETTING TRUMP’ to win Political Office, and Alvin Bragg, who also did not want to file this case against me, but he was forced by the Department of Justice and the Democratic Party.
