Diddy’s Lawyers Say His Rights Are Being Violated By Demanding Jail Cells
Sean “Diddy” Combs’ the legal team says a recent search of the music mogul’s cell violated his attorney-client privilege.
Diddy, 55, is currently being held at the Metropolitan Detention Center in Brooklyn while awaiting trial on sex trafficking charges. Days after prosecutors said in a motion Friday, November 15, that Diddy tried to interfere with the investigation by contacting witnesses while in custody, Diddy’s lawyers retaliated.
“The defense attorney recently discovered that the prosecution has confidential material, including the defendant’s documents. This search and seizure violates the rights of Mr. Combs’ Fourth, Fifth and Sixth Amendments,” lead attorney. Marc Agnifilo argued with him in a letter sent on Monday, November 18.
In court documents obtained by Us Weeklyasked Agnifilo Justice Arun Subramanian for an “expedited evidentiary hearing” to investigate the search, which he called a “targeted seizure” amounting to a “due process violation.” He asked to determine “who authorized the search of Mr. Combs, personal effects and papers” and “who decided which papers” should be turned over to the United States Attorney’s Office.
Agnfilo went on to say that Diddy’s legal team did not know that the singer’s notes were taken from his cell and given to the prosecutors until the prosecutors filed a motion on Friday accusing Diddy of trying to influence his trial. Prosecutors cited a review of Diddy’s phone records in a legal filing Friday, saying the rapper made “hundreds” of calls and texts in violation of prison rules using the phone accounts of other inmates.
“Since the defendant was detained in the MDC, he continued to try to evade the enforcement of the law, corruptly influence the testimony of witnesses, and attack the integrity of this trial,” read the court documents, obtained by CNN. “While trying to escape from law enforcement, the defendant, among other things, organized social media campaigns, in his words, aimed at defaming the jury; he makes efforts to publicly disclose material that he considers useful in his case; and contacted witnesses through third parties.”
Diddy was arrested and charged with sex trafficking, prostitution, conspiracy and transportation for the purpose of prostitution in September. The 14-page indictment accused him of hosting “elaborate and manufactured sex games” called “Freak Offs” and alleged that he used “coercion, threats of violence and coercion to get victims to engage in lengthy sexual acts with male sex workers.”

Diddy has denied the charges and denies the charges against him. He has been refused bail three times. The prosecutor made the latest claims about Diddy trying to “corruptly influence” the outcome of his case when he said his fourth bail application should be refused.
Diddy and his legal team proposed a new $50 million bail package earlier this month, saying he should be allowed to prepare for his May 2025 trial without prison due to changing circumstances and new evidence. The filing proposed an “extremely strict” bail package with house arrest, around-the-clock security monitoring and restrictions on Diddy’s contact with anyone outside of his legal team. A decision on the fourth bail attempt has not yet been released.
