Menendez’s Attorney Reveals Erik, Lyle Have Plans After Release

Their lawyer Mark Geragos he spoke to Us Weekly and other journalists at a press conference held by the Menendez family on Wednesday, October 16, saying, “I will not speak or [Erik and Lyle] have a plan. I just think that to make it through each day, you just have to be strong.”

Geragos noted that Lyle, 56, and Erik, 53, know how difficult the transition will be for them, adding, “It’s a long way to live out [parole] almost 17 years of hope.”

Erik and Lyle’s attorney went on to clarify that they are waiting for a new trial or for the siblings to be released.

“We initially filed a request to cancel the sentence. That is what the writ of habeas corpus is. Another part of this is anger. So two tracks,” explained Geragos. “You can suspend habeas while you are considering retribution. So it goes around chewing gum at the same time.”

He continued: “If habeas was granted, you would get a new trial.” If they are guilty, a judge under California law has the power to recall the sentence and sentence them to a variety of options.”

Geragos seemed optimistic about the outcome of the trial, which is scheduled for Tuesday, November 26.

“We may release it tomorrow but part of the mitigation package that we presented to the District Attorney in Los Angeles are letters from correctional officers – high-level officials – attesting to the incredible corrections,” he said. “We have a number of correctional officers who have said that if they are released, Erik and Lyle must be released and they will welcome them as neighbors.”

Erik and Lyle were initially arrested in 1990 for two murders after their parents, José again Kitty Menendez, they were found dead in their home. The two trials that followed resulted in Erik and Lyle being convicted and sentenced to life in prison without the possibility of parole. The brothers have always maintained that their mother and father abused them physically, emotionally and sexually and that their actions were self-defense.

The murder case has received renewed attention after Lyle and Erik received public support from the reality star Kim Kardashian. Their experiences are also dramatized Ryan Murphy‘s Netflix series Monsters, where Nicholas Alexander Chavez he healed Lyle while Erik was played by him Cooper Koch. José and Kitty, on the other hand, are portrayed by Javier Bardem again Chloe Sevignyrespectively.

Murphy has revealed how his show has sparked a renewed interest in Erik and Lyle – despite their disapproval of how they are portrayed.

“Now millions of people around the world are talking about them. There is a documentary coming out in two weeks about them, also on Netflix. And I think the interesting thing about it is asking people to answer the questions, ‘Should they get a new trial? Should they be released from prison? What is happening in our society? Should people be locked up for life? Is there no chance of renewal?’” he told Variety in September. “I’m interested in that, and a lot of people are talking about it. We ask really tough questions, and it gives these brothers another case in the court of public opinion. What I can say is, it is quite clear that this evidence that they have, maybe there will be a way forward.”

Erik and Lyle were granted a new hearing a month later after the Los Angeles County District Attorney’s office released new evidence, including a new letter Erik wrote to his cousin.
